Efficacy
The FDA has decided that delta-8 THC products should not be used in food. This is due to the fact that companies who add delta-8 THC to foods failed to submit the necessary safety data. In order for a product to be legally used in food, it must first be approved as GRAS (generally recognized as safe) by the FDA. However, because of the recent controversy surrounding delta-8 THC products, it is still unclear whether or not these drugs are effective in curing a range of conditions.
Legality
Recently, the Ninth Circuit Court of Appeals upheld the lower court’s preliminary injunction of two companies accused of selling counterfeit delta-8 THC products. AK Futures, the manufacturer of the delta-8 THC products, has a brand name based on a stylized letter “C” that depicts a two-tier cake. The companies sued Boyd St. Distro, LLC, a wholesaler of smoke and vaping products, for selling delta-8 THC vapes under the Cake brand. The district court granted a preliminary injunction in the case, but later ruled that the plaintiffs had to prove that they were selling the products.
Packaging
For a successful packaging of Delta8 THC products, it is imperative to choose materials that are food grade and sturdy. SBS (synthetic binder starch) is commonly used for packaging edible products, but you can also opt for environmentally friendly brown kraft paperboard. While this product-grade material is environmentally friendly, it is not as robust as SBS. In this case, you can consider contacting a design studio to work on custom-designed packaging options.
Safety
While the safety of delta-8 THC products is debatable, there are some benefits. Its mild side effects are similar to those of delta-9 THC, though they’re less intense. Delta-8 THC products may also contain related compounds like delta-9 THC and delta-10 THC. While delta-8 does cause a “high,” it’s less potent and doesn’t pose any significant risks to your health.
